TERMS AND CONDITIONS
These Terms and Conditions of Use apply to all cards issued by My Local Discount on and after 07 November 2016.
This document contains the full set of terms and conditions governing the use of the My Local Discount Card.
We recommend that you read this document carefully before using the Discount Card.

“My Local Discount” means My Local Discount ABN XXX of 1/3 Reef St, Gympie, Queensland 4570.
“Discount Card” means the physical discount card that you have purchased or received.
A reference to “we” or “us” is a reference to My Local Discount.
Discount Card Use & Exclusions
Except for the exclusions listed in paragraph 1.2 (Exclusions) below, once purchased or received, your Discount Card may be used to redeem discounts, promotions and other exclusive specials as offered by participating local businesses.
The following are the exclusions applicable to the redemption of your Discount Card:
a. Discount Cards cannot be used to purchase Discount Cards or other tender;
b. You agree that you will not use your Discount Card to purchase goods or services that a retailer is not permitted to supply to you (for example, a retailer cannot by law sell alcohol to you if you are under 18 years of age).
2. Using your Discount Card
2.1 Making a purchase with your Discount Card
To claim a discount, promotion or special, you will need to present your Discount Card at the point of sale at any participating store with the merchandise, goods or services that you wish to purchase using the Discount Card.
Should you fail to present your Discount Card at the time of purchase, the point of sale operator is not obliged to provide you with a discount.
Discounts, specials and benefits are subject to change on a daily basis, and without notice. Cardholders wishing to claim discounts, specials or benefits should visit the website to obtain current list of discounts offered by Merchants participating in the My Local Discount card program.
2.2 Exchanging items purchased with a Discount Card
Exchange and returns policy for discounted items purchased with the Discount Card is dependent on the policy held by each participating business. Discount Card holders looking to exchange or return an item must contact the participating store where the purchase was made.
2.3 Issue with goods or services purchased with a Discount Card
If you have an issue with any goods or services that you purchased with a Discount Card you should contact the participating store where the purchase was made.
3. No cash advances
Discount Cards are not legal tender, account cards, credit or debit cards or securities. You cannot obtain any cash advance with your Discount Card or redeem your Discount Card for cash.
3.1 No balance expiry date and transaction history
You will not be sent statements of transactions on a Discount Card. To check the expiry date, visit www.mylocaldiscount.com.au
3.2 Can I exchange my Discount Card?
You cannot exchange your Discount Card for tender, cash or any any other security.
3.3 Can I purchase a Discount Card using a Discount Card?
Discount Cards cannot be used to purchase another Discount card.
4. Expiry, cancellation and re-issue of Discount Cards
4.1 Expiry of Discount Cards
Your Discount Gift Card will be valid for use until December 31, 2017 or as otherwise extended by us after such time it will be invalid. Should you wish to claim discounts, specials and other promotions, you will need to purchase a current Discount Card.
4.3 Cancellation of Discount Cards
- Discount Cards cannot be cancelled once they are issued except if they expire.
b. We reserve the right to void any Discount Card that appears to have been defaced, mutilated, altered or tampered with in any way and My Local Discount may subject Discount Cards to a verification process.
c. We reserve the right to cancel Discount Card, or the Discount Card program, for any reason at any time without notice.
4.4 Re-issue of damaged Discount Cards
A re-issue of faulty or damaged Discount Cards is not available unless the fault or damage to the Discount Card is proven to be a result of the production process or otherwise due to the fault of us or our agents or contractors.
5. No Replacement for lost or stolen Discount Cards
You are responsible for the use and safety of your Discount Card. Treat your Discount Card like cash. Lost or stolen Discount Cards will not be replaced or refunded. The bearer of the Discount Card will be taken to be the owner of the Discount Card.
6. Changes to Terms and Conditions of Use
We reserve the right to change any of the terms contained in these Terms and Conditions of Use at any time for any reason, and agree to provide you with at least 30 days notice of such changes.
We will give you notice by posting the changes on www.mylocaldiscount.com.au.
Our Privacy and Security Notice explains how we handle the personal information that we may collect from you with respect to the Discount Cards. If you do not have a copy and are unable to access the notice online (at www.mylocaldiscount.com.au), please email us.
8. Errors and complaints
If you have reason to believe that an error has occurred in relation to your Discount Card, please email us immediately.
9. Limitation of liability
You have certain rights under the Australian consumer legislation which cannot be excluded and are not affected by these terms and conditions. Except for those statutory rights, any conditions implied by any other laws are excluded from these Terms and Conditions of use.
To the extent permitted by law, if we are liable to you, our maximum aggregate liability to you is limited to the value of the Discount Card.
10. Applicable law
These Terms and Conditions of Use are to be construed and enforced in accordance with the laws of Queensland, Australia. Any dispute in connection with a Discount Card is exclusively subject to the jurisdiction of the courts of Queensland, Australia.
